Moderna is seeking a Sr. Counsel to join the Intellectual Property/Legal Team in building, managing, defending and enforcing the company’s intellectual property rights. This person will be responsible for supporting in-house counsel in the capturing of innovation, development of the intellectual property estate and counseling of the internal client with regards to due diligence efforts, patentability, freedom-to-operate and other intellectual property-related matters.
The successful candidate will have the opportunity to work on a wide range of intellectual property issues in a rapidly growing, disruptive biotechnology company. The successful candidate will develop deep expertise in the mRNA therapeutics field to assist in all aspects of patent portfolio development and management. The qualified applicant will thrive in a fast-paced, proactive culture and competently handle the intricacies of a complex ecosystem of platform, therapeutic area and corporate partner intellectual property needs. They will be a both a self-sufficient performer as well as a team player in their role in supporting the advancement of critical intellectual property goals of the company.
Here’s What You’ll Do
Develop, manage and counsel on all patent aspects of platform and product lifecycle portfolios, including strategy, prosecution, patent office proceedings, freedom to operate, enforcement, due diligence and related transactions
Collaborate with and provide expert counsel to scientific, development, commercial and legal colleagues on a variety of intellectual property issues relating to the discovery, development and commercialization of novel mRNA technologies and products
Direct the analysis of complex factual and legal scenarios involving various aspects of intellectual property to provide timely, practical, and actionable guidance to internal clients in research, development and commercial functions
Provide input and support to SVP, Intellectual Property and IP Team colleagues on corporate IP strategy and tactics; collaborate with other Legal Department members and lead discrete projects as appropriate
Here’s What You’ll Need (Minimum Qualifications)
J.D. from a national law school and admission to any U.S. state bar; eligible to register as in-house counsel in Massachusetts
12+ years of experience handling complex intellectual property matters in the biotechnology and/or pharmaceutical industries with a deep understanding of patent strategy, ideally gained in both a top law firm and an in-house setting
Registered to practice before the US Patent and Trademark Office
Here’s What You’ll Bring to the Table (Preferred Qualifications)
Experience in patent preparation and prosecution, due diligence, patentability and freedom-to-operate assessment required; litigation and transactional experience preferred
Demonstrated understanding/experience with international patent legal issues and strategies highly preferred
Creative and strategic mindset and approach to intellectual property with the demonstrated ability to anticipate future business, competitive, and legal risks while identifying creative solutions and opportunities
Proven business acumen, strong analytical skills, and the ability to grasp important business, legal, and financial issues facing the Company
Executive presence and the ability to interact confidently with executives, coupled with the ability to explain complex matters in a simple way that is easily understood
Ability to manage and prioritize multiple matters simultaneously, in a fast-paced environment, and to respond quickly, clearly and pragmatically to urgent situations and rapidly shifting priorities in ambiguous or challenging situations
Adept at balancing risk and opportunity even in ambiguous circumstances and in a highly accountable environment where you can make a clear impact
Excellent analytical, communication, interpersonal and negotiation skills and an ability to develop relevant and realistic plans, programs, and recommendations to influence great outcomes
