About this opportunity
We are looking for an exceptionally qualified Senior Counsel, Labor and Employment with a deep understanding of global labor and employment law to be a part of our corporate legal team. The successful candidate should be able to operate autonomously and comfortably within a fast-paced, quickly evolving environment. You are intellectually astute, analytically precise, have a strong bias for pragmatism and possess a broad range of experiences.
Location: Tempe, Arizona
In this role, you will…
- Design, create and implement a global, strategic roadmap for enterprise labor and employment legal needs for a 24,000+ employee, global, multinational company.
- Develop and devise best practices, tools, guidelines, programs, training, and solutions that can be efficiently implemented across multiple operating companies and geographies and empowers regional legal teams and HR business partners to address ongoing employment counseling needs.
- Identify and assess legal risks within the labor and employment area and partner with internal stakeholders to drive strategic initiatives, employment-related policies, guidelines, and processes for compliance in the highest risk areas (global wage and hour, co-employment, remote work, classification, works council, discrimination, etc.) and meet other strategic objectives.
- Create risk-based schedules for employment practices audits (policies, procedures, forms, practices) to ensure compliance.
- Work collaboratively with regional legal teams, HR and other stakeholders to navigate issues from non-competition agreements, hiring and recruiting, discipline, investigations, wage and hour, leaves of absence, workplace accommodations, terminations, workforce restructuring, investigate and respond to demand letters and administrative or governmental inquiries and related matters. Advice and counsel will be both on daily issues and strategic and systemic plans
- Provide high-quality legal advice in a timely fashion to the General Counsel, in-house legal teams, and Human Resources on high-risk global labor and employment related matters.
- Establish and maintain relationships, credibility and trust with clients, stakeholders, legal team members and other colleagues across a multi-cultural business environment with demonstrated global sensitivity.
- Monitor new laws, regulations and decisions affecting relevant substantive legal areas and provide strategic advice to company leadership. Educate clients and stakeholders on developments and lead training efforts as appropriate based on risk assessment, strategic objectives, and legal developments.
- Provide advice and counsel on global worker issues, particularly as to workers located in corporate R&D, manufacturing and treatment planning facilities. Collaborate with local counsel as needed.
- Support in-house litigation counsel on any labor and employment litigation.
- Manage and evaluate use of outside counsel on employment related disputes. With in-house litigation team, set strategy for dispute handling and arbitrations (including development and maintenance of a compliant arbitration program); participate in mediation/settlement conferences and prepare/review settlement papers as appropriate. Provide cost oversight and derive data-driven insights from outcomes to provide strategic advice to the General Counsel.
- Support employment-related aspects of mergers, acquisitions, strategic investments, and divestitures, including due diligence and related integration efforts.
- Advise on employee representative structures, including works councils.
- Maintain a culture with a high degree of emphasis on dignity, respect, and inclusion.
In this role, you’ll need …
- A high degree of skill as a labor and employment lawyer, with the ability to prioritize, manage a heavy workload and meet deadlines in a fast-paced, high volume, time-sensitive environment.
- Excellent written and verbal communication and interpersonal skills within and across departments and externally; must be proactive in providing counsel to clients with the ability to inspire confidence. Comfortable with public speaking and communications with C-Suite executives.
- Sound judgment: ability to clearly make reasoned decisions and recommendations and determine who should be kept informed.
- Self-starter with good business acumen and a sense of urgency, honesty, and fairness.
- Demonstrate leadership and strong relationship management skills. Ability to build and maintain productive relationships with leaders of other functional areas within and across the business areas to seek alignment on objectives for the benefit of Align.
- Experience handling labor and employment matters before international as well as domestic federal and state courts and administrative agencies.
- A willingness and the ability to work in a global environment, which includes handling calls outside normal working hours on a regular basis.
- Ability to effectively navigate and work efficiently in a matrix, multidisciplinary organization.
- High integrity and ethics in all dealings.
- Able to travel domestically and internationally (up to 15%).
- Juris Doctorate from an accredited law school with active bar membership in one U.S. state bar.
- 10+ years of experience in global, labor and employment law department and recognized law firm. California, Arizona, North Carolina, European, APAC labor and employment law experience a plus.
- Good sense of humor, openness to learning, resiliency and collaborative personality.
