The NC Department of Justice (NC DOJ) is looking for a leader, strategist, and partner to help us provide excellent representation and support to our client, the North Carolina Department of Revenue (DOR). This position will be responsible for setting the tone and providing leadership and management for the NC DOJ's Revenue Section. This work is precedent-setting and critical to ensuring that taxes are properly collected to allow State government to function and provide services to the people of North Carolina. The Section is comprised of five attorneys, including this position, a paralegal, and an administrative specialist. It is incumbent upon this position to have the ability to learn and develop a understanding of the State’s tax laws and other laws relevant to the operations of the DOR. As a member of the management team, this position will be responsible for supporting the client and successfully balancing the needs of the NC DOJ and its initiatives.
THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $109,482 to $128,905. Salary determination is based upon the candidate's education and experience related to the position, as well as departmental budget and equity considerations.

If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions. The Department also represents the State in criminal appeals from state trial courts, and brings legal actions on behalf of the state and its citizens when the public interest is at stake.
This position directs, manages, and supervises the Revenue Section and its complex and highly specialized legal work on behalf of the Department of Revenue. The attorney in this position also litigates tax cases and other matters for the Department of Revenue, either solely or jointly, as lead-counsel or as non-lead counsel, with other attorneys in the Section.
The entire Revenue Section specializes in the advanced and extremely complicated area of tax law. It also has advanced legal experts in the complex and advanced area of bankruptcy law. The Section Head is responsible for supervising all of the work performed by the Section, leading a cohesive work group, collaborating on trial and settlement strategies with attorneys in the Section, and managing his or her own active caseload. The attorney in this position supervises four attorneys, support staff positions, as well as any other individual(s) that may work in the Section.
Represents the Department of Revenue and its Employees in Civil Litigation
The Section Head’s specialized legal duties include the supervision and performance of the following legal work: The attorney is responsible for the Section’s complex litigation with a heavy emphasis on the highly technical and advanced areas of tax law and bankruptcy law. The position collaborates on trial and settlement strategies with attorneys in the Section and offers litigation recommendations to the Department of Revenue. The cases handled by the Section and this position often involve millions of dollars and have far reaching impact on the Department of Revenue, State government, and the state. The representation of the Department of Revenue in such cases is extensive and typically involves responding to expansive discovery requests, assembling voluminous discovery documents for transmittal to other parties, taking and defending depositions and presenting arguments on behalf of the Department of Revenue in administrative tribunals, business court, the North Carolina Supreme Court, and other courts. Many of the cases are precedent setting. Additionally, the position and the Section respond to subpoenas from the US Department of Justice in IRS matters.
Other duties will include:
- Performs Special Project Assignments and Other Legal Duties
- Advises the Department of Revenue on other legal issues
- Responds to Inquiries from Non-Client State Agencies, Legislators, the Judiciary, Local Judiciary, Local Government Agencies and the General Public
- Represents the state in criminal appeals.
The Section Head must have the advanced legal knowledge necessary to lead this specialized complex legal practice.
Must have advanced knowledge of the highly technical field of tax law or demonstrate the commitment and ability to master a highly technical area of law.
Thorough knowledge of case, statutory, regulatory, and common law.
Ability to interpret and apply dense State statutory schemes with an overlay of Federal statutes. Thorough knowledge of judicial and quasi-judicial procedures.
Ability to litigate advanced and highly technical tax matters or other highly specialized areas of law.
Ability to conduct complex civil litigation in trial and appellate courts.
Ability to analyze highly technical tax issues or other highly technical legal issues.
Ability to interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions.
Ability to analyze facts, evidence, and legal instruments.
Excellent negotiation skills.
Ability to express conclusions and arguments clearly and logically in oral and written form. Ability to analyze legal problems and render formal opinions.
Desire to continue to grow and develop ones knowledge and skills, and the ability to assist others in the Section to grow and develop their knowledge and skills.
Proven ability to use good judgment and discretion in performing one’s job responsibilities and to effectively collaborate with others both throughout DOJ and outside of DOJ.
Ability to establish and maintain effective working relationships both throughout DOJ and outside of DOJ.
Ability to effectively and independently lead and manage a cohesive team of highly specialized professionals and support staff.
Ability to perform administrative tasks on a timely basis.
Ability to develop creative solutions to legal issues and management challenges.
Ability to multi-task and prioritize effectively, and lead the others in the Section to do the same.
Ability to interact diplomatically and tactfully with others, especially high-level government officials.
Ability to promptly make management and legal strategy decisions and promptly execute on those decisions.
Licensed to practice law by the North Carolina State Bar and five years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
