The Role

The Fidelity Workplace HIPAA Compliance Officer will develop a HIPAA compliance program, administer policies and procedures. Implements processes designed to drive a well-rounded, cross-enterprise perspective of products, services and other activities across Fidelity Workplace that are subject to, or otherwise implicate, HIPAA, HITECH, and related health privacy laws. Provide subject matter expertise on HIPAA regulatory-related topics and develop and implement monitoring processes and assessment activities around PHI-related topics. This is a new role that will operate across the Workplace Enterprise to strengthen processes in areas where regulations are directly applicable or may be indirectly implicated.

This role will report to the WI Chief Compliance Officer and will make sure the Protected Health Information and electronic PHI (ePHI) received, transmitted and/or stored by Fidelity in connection with providing Workplace products and services is protected in accordance with the HIPAA Privacy and Security Rules. You will serve as a subject matter expert regarding HIPAA, HITECH and related federal and state health privacy laws.

The HIPAA Compliance Officer will be proficient in the policies and procedures needed to develop and implement appropriate training for all incoming and existing employees. This role will also be assessing existing governance, policies, and processes and evolving them as needed to improve compliance risk management across a range of products, services, and activities, potentially including products and services offered through third-party entities or affiliates.

This is an individual contributor role, may manage some staff. A successful candidate will collaborate with cross-functional teams within Fidelity (Privacy Compliance and Fidelity Workplace Compliance, Risk, Cyber, Legal, Contracts, and Businesses) to achieve objectives. Specific responsibilities of the role will include:

  • Establishing and maintaining an inventory of activities across the Workplace Business that have a PHI nexus, providing a comprehensive and enterprise view
  • Providing compliance risk management support to legal entities
  • Serving as a compliance expert with respect to existing products and services
  • Providing expertise on HIPAA, HITECH, and related federal and state health privacy laws and privacy laws in general and supervising for changes in applicable requirements and mentorship as well as modifying the compliance program as needed to comply
  • Ensuring adherence to restrictions associated with receiving, transmitting, and storing ePHI
  • Supporting the evaluation of new products, services and activities that have a potential PHI data, identifying and leading the buildout of compliance processes
  • Supporting periodic HIPAA risk assessments and remediation plans
  • Meet with partners across the enterprise, as needed, may require travel to various Fidelity locations.

The Expertise You Have

  • Strong background in HIPAA privacy and security, with a degree in Law or Compliance Health Care.
  • Certification as HIPAA Security Expert, Society for Human Resource Management or equivalent experience preferred
  • Experience developing, implementing and/or leading compliance activities across large institutions, HealthCare, or other fields where HIPAA regulatory adherence applies frameworks
  • A track record of successfully operating across diverse business units, motivating change, and influencing partners to improve awareness of applicable regulations and strengthen risk management processes
  • 15+ years of compliance or related experience at a healthcare service firm, tax exempt institution, regulatory agency, law firm or major consulting firm
